IMPORTANT NOTICE: These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "Player," "you") and phssky ("Company," "we," "us," "our") governing your access to and use of the phssky website located at phssky.cam and all associated services, games, and applications (collectively, the "Service"). Each Player is permitted only one (1) account on the phssky platform. Creating multiple accounts is strictly prohibited and constitutes a material breach of this Agreement. phssky reserves the right to close duplicate accounts, confiscate any winnings, and forfeit any bonuses associated with such accounts. This restriction applies regardless of whether multiple accounts use different contact information or payment methods.

3. Deposits and Payments

3.1 Deposit Methods

phssky accepts deposits via GCash, PayMaya, bank transfers, and other payment methods designated on our platform. All deposits must originate from payment accounts registered in your own name. 5. Bonuses and Promotions

7. Intellectual Property

7.1 Ownership

All content, software, graphics, designs, logos, trademarks, and other intellectual property displayed on the phssky platform are owned by phssky or licensed from third-party providers. You acquire no ownership rights by accessing the Service. You may not copy, reproduce, distribute, transmit, display, modify, or create derivative works from any phssky intellectual property without express written permission.

7.2 Limited License

phssky grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial entertainment purposes. This license terminates automatically upon any breach of these Terms or closure of your account.

8. Limitation of Liability

8.1 Service Availability

While phssky strives to maintain 99.9% uptime, we do not guarantee uninterrupted access to the Service. The platform may become temporarily unavailable due to scheduled maintenance, technical difficulties, internet connectivity issues, or circumstances beyond our control. phssky shall not be liable for any losses resulting from service interruptions.

8.2 Disclaimer of Warranties

THE PHSSKY SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PHSSKY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PHSSKY DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

8.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW, PHSSKY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL. PHSSKY'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU DEPOSITED INTO YOUR ACCOUNT DURING THE SIX (6) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless phssky, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your use or misuse of the Service; (c) your violation of any third-party rights; or (d) any fraudulent or illegal activities conducted through your account.

10. Dispute Resolution and Governing Law

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines.

10.2 Dispute Resolution Process

In the event of any dispute arising from your use of phssky, you agree to first attempt informal resolution by contacting our customer support team. If informal resolution fails, disputes may be submitted to binding arbitration in accordance with Philippine arbitration law.

11. Account Closure and Termination

11.1 Voluntary Closure

Players may request voluntary account closure at any time by contacting customer support. Upon closure, any remaining account balance will be returned to you via your registered withdrawal method, subject to verification and wagering requirements. Self-excluded accounts cannot be reopened during the exclusion period.

11.2 Termination by phssky

phssky reserves the right to suspend or terminate your account immediately, without prior notice, for any violation of these Terms, fraudulent activity, or other conduct deemed harmful to the platform or its users. Upon termination, phssky may forfeit your account balance if such forfeiture is justified by your conduct.
